Terms of use

Last updated

By using bizkindly.com you agree to these terms.

Who can use the site

You must be at least 18 years old and a resident of the United States to use bizkindly.com and any offers or options shown on it. If you use the matcher for a business, you confirm you are authorized to share its details.

Education, not advice

BizKindly is an education site, not a lender, broker or adviser. Nothing here is financial, legal or tax advice, and we do not decide whether any company will work with your business.

Our guides are general information about running and funding a business. They are not an offer, a quote or a decision by anyone.

How the matcher works

The matcher asks a few questions about your business and then lists companies to explore. It is not an application, it does not check your credit, and BizKindly does not negotiate terms or act as a broker. BizKindly is paid by advertisers; this affects which options appear and in what order. Whether any company will work with your business, and on what terms, is decided only by that company, on its own site.

Other companies' sites

Opening an option takes you to another company's website in a new tab. Their terms and privacy policy apply there. We do not control their products, decisions, fees or content, and we are not a party to anything you agree with them.

Using the site fairly

Please give your own details, once. Automated submissions, attempts to get around our limits and attempts to interfere with the site are not allowed, and we may block them.

No guarantees

We work to keep our guides accurate and dated, but rules, rates and fees change, and we do not promise that any information is complete or current, or that any company will offer you a product. The site is provided “as is”. To the extent the law allows, BizKindly is not liable for decisions you make based on it or for anything a company does on its own site.

Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The arbitration section below is also governed by the Federal Arbitration Act.

Arbitration and class-action waiver

Please read this section carefully. It affects how disputes are resolved. You and BizKindly agree that any dispute or claim arising out of or relating to these Terms or your use of the site will be resolved by binding individual arbitration, rather than in court, except as described below. The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules. The Federal Arbitration Act governs this agreement to arbitrate.

Class-action waiver. You and BizKindly agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective or representative action. The arbitrator may not combine more than one person's claims or preside over any form of class or representative proceeding.

Small claims. Either party may instead bring an individual claim in small claims court, as long as it stays in that court and is not removed or appealed to a court of general jurisdiction.

Your right to opt out. You may opt out of this arbitration agreement by mailing a written notice within 30 days after you first use the site to BizKindly, 16192 Coastal Highway, Lewes, DE 19958, US. Include your name, your email address and a clear statement that you are opting out of arbitration. Opting out does not affect any other part of these Terms.

If the class-action waiver is found unenforceable for a claim, that claim will proceed in court and not in arbitration.
